These Terms and Conditions ("Terms") govern your access to and use of www.trybaldur.com (the "Site") and the purchase of products from TryBaldur, operated by Veloce Digital LLC ("TryBaldur," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By visiting the Site, creating an account, or purchasing products, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy and Returns & Refunds Policy.

2. Products and Services

2.1 Product Descriptions

We make every effort to ensure that product descriptions, images, and specifications on the Site are accurate. However, we do not warrant that product descriptions or other content on the Site are error-free, complete, or current. Please note that the actual color, shade, or appearance of a product may vary slightly from the images shown on the Site due to screen and display settings. If a product offered on the Site is not as described, your sole remedy is to return it in accordance with our Returns & Refunds Policy.

2.2 Pricing

All prices displayed on the Site are in US Dollars (USD) and are subject to change without notice. Prices do not include applicable taxes or shipping, which are calculated and displayed at checkout. We reserve the right to refuse or cancel any order placed at an incorrectly listed price.

2.3 Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time without notice. If an item in your order is unavailable after your order has been placed, we will notify you and provide a full refund for the unavailable item(s).

3. Orders and Payment

3.1 Order Acceptance

Placing an order on the Site constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product unavailability, errors in pricing or product information, or suspected fraudulent activity. Your order is accepted when we send you an order confirmation email and dispatch your items.

3.2 Payment

We accept major credit and debit cards and other payment methods displayed at checkout. By providing payment information, you represent and warrant that you are authorized to use the payment method and that the information is accurate. All transactions are processed through secure, PCI-DSS compliant payment processors. We do not store full payment card information.

3.3 Subscription Orders

If you subscribe to a recurring purchase, you authorize us to charge your payment method on the agreed billing schedule. You may cancel your subscription at any time before the next billing date through your account dashboard or by contacting us at trybaldurr@gmail.com. Subscription prices are subject to change with reasonable prior notice.

3.4 Sales Tax

We collect sales tax on orders shipped to states where we have a nexus and where digital sales tax law requires it. Applicable taxes will be displayed at checkout before you complete your purchase.

4. Shipping and Delivery

Shipping terms, delivery timelines, and related information are governed by our Shipping Policy, which is incorporated into these Terms by reference. We are not responsible for delays caused by shipping carriers, customs, natural disasters, or other events outside our control.

6. Cosmetic Product Disclaimer — CRITICAL

COSMETIC USE DISCLAIMER: TryBaldur products are cosmetic and personal-care products intended for external use only. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease, skin condition, or other medical condition. The statements made on this website and in our product descriptions have not been evaluated by the United States Food and Drug Administration (FDA).

By purchasing and using our products, you acknowledge and agree to the following:

• Our products are cosmetics for external use only and are not intended to replace medical or dermatological treatment.
• Individual results vary. Any testimonials, before-and-after images, case studies, or results described on this Site represent individual experiences and are not typical or guaranteed.
• You should perform a patch test before first use (see Section 6.1) and consult a qualified healthcare professional or dermatologist before use if you have sensitive skin, a known skin condition, allergies, or any other medical concern, or if you are pregnant or nursing.
• Do not use our products as a substitute for professional medical advice, diagnosis, or treatment.
• If you experience any irritation, redness, rash, or other adverse reaction after using our products, discontinue use immediately and consult a healthcare professional if the reaction persists or is severe.
• Keep all products out of reach of children.
• Avoid contact with the eyes. If a product enters the eyes, rinse thoroughly with water.
• For external use only. Do not ingest. Do not apply to broken, damaged, or irritated skin.
• Store products as directed on the label and observe any Period After Opening (PAO) guidance shown on the packaging.

6.1 Specific Product Warnings

Before using any TryBaldur product for the first time, we strongly recommend performing a patch test: apply a small amount to a discreet area of skin (such as the inner forearm) and wait 24–48 hours to check for any reaction.

Discontinue use and consult a healthcare professional if irritation occurs. Take particular care in the following circumstances:

• If you have sensitive, allergy-prone, or reactive skin, or a known skin condition (such as eczema, rosacea, or dermatitis).
• If you are pregnant or nursing — consult your healthcare professional before use.
• If you are using prescription topical treatments or medications — consult your physician, as some ingredients may interact with them.
• Certain active ingredients (for example, exfoliating acids or retinoids, where present in a formula) may increase your skin's sensitivity to sunlight. Where applicable, we recommend using sun protection and following the usage directions on the product label.
• Avoid contact with the eyes, lips, and mucous membranes unless the product is specifically formulated for those areas.

Always read and follow the ingredient list, directions, and warnings printed on each product's label.

7. Use of the Site

If you submit reviews, photos, testimonials, or other content to the Site or to our social media channels ("User Content"), you grant TryBaldur a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, and display such User Content in connection with our business and marketing, without compensation to you. You represent that you have the right to grant this license and that your User Content does not violate any third-party rights or applicable laws.

10. Disclaimer of Warranties

The Site and all products and services offered through it are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

TryBaldur does not warrant that: (a) the Site will be uninterrupted, error-free, or secure; (b) defects in the Site will be corrected; (c) the Site or the server that makes it available are free of viruses or other harmful components; or (d) the information on the Site is accurate, complete, or current.

11. Limitation of Liability

To the fullest extent permitted by applicable law, TryBaldur, Veloce Digital LLC, and their officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses — arising out of or related to your use of the Site or our products, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising out of or related to your use of the Site or purchase of products exceed the total amount you paid to us in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the Site or purchase of products shall first be submitted to good-faith negotiation. If not resolved within 30 days, disputes shall be resolved by binding arbitration in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules, conducted in Wilmington, Delaware. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.
